New, higher minimum wage rates for drivers transporting goods in the territory of Austria have been in force since the beginning of 2018. For example: the rate of an up to 3.5 tons bus driver has changed from EUR 8.49 to EUR 8.72.

Let us recall that on 1 January 2017, a new law on combating wage and social dumping entered into force in Austria (Lohn- und Sozialdumping-Bekämpfungsgesetz, below: LSD-BG). The procedure for reporting the posting of employees and paying the minimum wage applies to transport companies that transport goods and people, not only in the case of cabotage, but also in the case of importing to and exporting from Austria.

In conclusion, the Austrian minimum wage law applies to all transport operations except transit. In the case of mobile workers from the transport industry, such a notification should be made BEFORE the employee enters the territory of Austria. In accordance with § 19 sec. 2 of LSD-BG, the application must be submitted exclusively and compulsorily by means of the ZKO3 electronic form issued by the Austrian Ministry of Finance (Bundesministerium für Finanzen).
