Today’s headline story: Deliveroo’s delivery drivers are employees and not self-employed, rules the Dutch Supreme Court
The Dutch Supreme Court has upheld a decision by the Amsterdam Court of Appeal that ruled Deliveroo’s delivery drivers in the Netherlands are employees under an employment contract.
The court stated that the existence of an employment contract depends on all the circumstances of the case, and based on the circumstances of this case, the Deliveroo drivers had an employment contract.
This ruling could make it challenging for Deliveroo to re-enter the market, as the company may need to “make unreasonable investments with uncertain long-term returns” to maintain its top market position in the Netherlands.
Moreover, it could pave the way for legislators to boost gig worker rights in the country.
