The update, outlined in the Decree on the Prevention of Infringements published in the Official Journal on 16 September 2024, aims to address issues that have led to infringement proceedings against Italy about its transport sector.

The decree, reports Transporti-Italia, is part of a wider effort to close several infringement proceedings and pre-infringement cases against the Italian state, with a focus on aligning the country’s regulatory framework with EU Directive 1057/2020. A key provision of the Decree relates to roadside checks on lorries and heavy vehicles, as detailed in Article 6.

The amendment introduces a new paragraph that allows drivers to rectify missing documentation related to the use of tachographs before the end of the roadside check. Specifically, drivers are now authorised to obtain the necessary documents through their headquarters, transport manager or other responsible parties during the check.

This update offers flexibility to drivers and aims to avoid sanctions for errors that may not be directly attributable to the driver or the transport company, explains Transporti-Italia.

The article adds that this adjustment is intended to ensure that drivers comply with their obligations regarding the use of tachographs, while at the same time providing a means to correct potential administrative errors during roadside inspections.

These changes are expected to streamline procedures and help avoid penalties for technical or documentary errors, further strengthening Italy’s compliance with EU transport regulations.
