Today the EU Ambassadors approved the compromise text of the amendment to the Posting of Workers Directive negotiated with the European Parliament. Now the draft amendment to the Directive will go to the European Parliament, where it will be finally adopted. According to earlier announcements, MEPs will vote on this matter on 21 June.
From the point of view of the transport industry, the most important thing is that international road transport will be covered by sectoral legislation, which will only be included in the Mobility Package.
As for the other industries, the purpose of the revised directive is to facilitate the provision of services while ensuring fair competition and respect for the rights of workers employed in one Member State and sent to work temporarily in another country.
“With today’s agreement, the EU delivers on the important principle of equal pay for equal work, ensuring that all workers are treated fairly across the Union. Local or posted workers doing the same job at the same place will have the same working and wage conditions. The agreement is also fair and balanced since it helps preserve the free provision of services”- summarized Biser Petkov, Bulgarian Minister of Labor and Social Policy and President of the Council.
The amendments to the directive concern remuneration, allowances, long-term posting, collective agreements, cooperation on fraud and abuse and the extension of the posting period by 6 months based on the “reasonable notification” presented by the company to the authorities of the host country.
The new rules are to come into effect two years after the entry into force of the new directive. Assuming that it will be finally approved by the end of June, entrepreneurs will have to adhere to it more or less from the second half of 2020.
