Haulier fined €60,400 for multiple drivers’ hours violations among its staff

A Latvian haulier has been fined DKK 450,000 (just over €60,400) by the Roskilde Regional Court after it failed to pin all the responsibility for its drivers' hours violations on its staff.

The case dates back to an inspection in October 2020 that saw a Latvian-registered HGV checked on the Køge Bugt Motorway near Karlslunde.

During the inspection, officers found that the driver was using the tachograph card of another person.

The company was later charged with being responsible for some of its drivers repeatedly using tachograph cards other than their own, and regularly violating drivers’ hours rules.

In order to try and escape punishment, the haulier maintained it was not guilty and that its drivers were solely responsible for their violations.

However, the haulier’s attempts to pin the blame on its drivers backfired, and now the firm must fork out to pay a fine of just over €60,400.

In any case, two of the company’s drivers had already been punished for their drivers’ hours breaches. One was fined DKK 74,000 (around €9,937) and given a 30-day suspended sentence, while the other was fined DKK 67,500 (approximately €9,000) and handed a 20-day suspended sentence.

If the haulier wants to try and avoid paying the fine, it will have to make do without two of its trucks. The authorities are holding onto the vehicles until they receive payment.
