Germany: haulier to be investigated over “considerable violations of driving and resting times”

A road transport firm is to be investigated by the authorities in Germany after one if its drivers was found to have broken drivers' hours rules considerably on a number of occasions.

The 34-year-old driver was hauling a refrigerated trailer on the A3 last week when he was pulled over for checks at the Steigerwald-Nord rest area.

The inspectors then identified significant violations of the driving and rest times; including a 25-hour shift with no proper rest.

Moreover, the trucker’s daily rest time on occasions was as short as 1 hour and 15 minutes. Weekly rest periods were shortened too, in one case by more than 50%.

The driver, who was banned from continuing his journey, faces a fine in the high four-digit range. His employer is also being investigated. According to the police, the number of drivers' hours violations the trucker had committed since last December means that the fine for the transport company runs into 6 figures.

The case is now in the hands of the BAG, who will decide on the total value of the fines and prosecute the haulier for its offences accordingly.
