Germany: Inspections of the 45-hour rest are less strict for a time being

The Federal Office for Freight Transport BAG informs that the controls related to the prohibition of spending the 45-hour break in the can will have…. and educational character. More inspections and high fines will be expected in the future.

German transport website eurotransport.de informs about the speech of the head of the BAG office, Andreas Marquardt, on inspections of the weekly rest.

Marquardt said that for 3 months after the prohibition enters into force (i.e. from 25 May this year) there will be a transitional period during which the inspections will be educational. The aim is not to punish but to increase the awareness of the rules among drivers and carriers. In addition, over the next 2 months BAG wants to refine the methods of effective inspections.

The transitional period will last, according to eurotransport.de, until the end of August. From September “culprits” will be severely punished. Violating the ban on spending 45-hour break in the cab will be severely punished in Germany. For the misdemeanour the driver will pay a fine of 500 euro while the company owner will pay 1500 euro.

Hello, With regard to the inspections in Germany, last weekend there was an inspection at Raststätte by A5 in the direction of Frankfurt am Main. They inspected 11 trucks – three Poles, that is trucks with Polish plates, a few Romanians and several Poles with German plates. All of the drivers who wanted to do the 45 h break had their tachograph switched to work and then to pause again after a few minutes. Everyone got the information that they are not allowed to do 45 h in the car. Nobody was fined.”

As we reported last week, BAG inspectors already started working on 18 June.
