The action concerns the Delegated Directive (EU) 2024/846, which updates the list of serious infringements under Regulation (EC) No 1071/2009. This regulation establishes common rules for access to the profession of road transport operator, including the requirement to maintain a good reputation in order to legally provide transport services within the EU.
Under the directive, which had to be transposed into national law by 14 February 2025, Member States are required to align their domestic legal frameworks with the revised EU-level criteria. These updates are crucial for ensuring consistent enforcement across the single market and upholding high professional standards in the road haulage and passenger transport sectors.
The countries targeted by the infringement procedures are: Belgium, Bulgaria, Denmark, Germany, Estonia, Croatia, Italy, Cyprus, Luxembourg, Hungary, Austria, Portugal, Slovenia, Slovakia, Finland, and Sweden.
As a first step in the infringement process, the Commission is sending letters of formal notice to the Member States concerned. They now have two months to respond, complete the transposition, and notify the Commission of the national measures they have adopted. In the absence of a satisfactory response, the Commission may proceed with the next stage of the procedure by issuing a reasoned opinion.
The updated offence classification under Directive 2024/846 plays a key role in enhancing road safety, promoting fair competition, and ensuring that only operators who comply with EU social and safety rules are allowed to remain active in the market.
