German court refuses interim injunction in Toll Collect overpayment refund case

The association Camion Pro e.V. has applied for an interim injunction against the state-owned company Toll Collect GmbH. The association accuses the operator of the German toll system of obstructing and delaying the reimbursement of overpaid tolls.

At a hearing on 26 February, the Berlin District Court rejected Camion Pro’s application for an interim injunction against Toll Collect GmbH. The court did not consider the case to be urgent enough to warrant the issuance of a so-called interim order.

The reasons for the ruling are not yet known, reports Camion Pro.

We will study (the court’s decision – editor’s note) and then decide together with our lawyers whether it is in the interest of our members to take further legal action, – commented Andreas Mossyrsch, board member of the trade association Camion Pro e.V.

As a reminder, at the beginning of February, the German transport association Camion Pro applied for an interim injunction. The association argued that Toll Collect, the operator of the toll system, was abusing its dominant market position by multiplying bureaucratic obstacles and imposing unjustified and excessive charges on hauliers in the ongoing process of reimbursing overpaid tolls.

The organisation claims that affected companies have to go through a complicated reimbursement process, where they have to prove the amount of tolls paid and provide detailed billing records, which Toll Collect is likely to have.
