In January this year, the Spanish Ministry of Transport announced joining the group of states that enforce the ban on taking a regular weekly rest in the cabin of a truck. Originally, the new rule was to enter into force in July this year.
The ban on taking regular weekly rest in the truck cabin is to be introduced in Spain by implementing regulation to the Road Transport Act, i.e. ROTT. Originally, ROTT was supposed to enter into force on July 1 this year. However, in connection with the judgment of the Court of Justice of the European Union regarding the Spanish provisions on access to the profession of a carrier, which violate EU law, the work on the regulation had to be extended.
According to the announcement of the Ministry of Transport of Spain, the new ROTT will come into force on January 1, 2019. That’s when the ban on taking 45-hour rest in the cabin will also apply.
According to the Spanish association of transporters ASTIC, the fine for taking the weekly break in Spain will be 1,000 euros.
